Abstract
Held: (i) Failure to investigate before initiating disciplinary proceedings renders termination procedurally unfair. (ii) Rule 13(1) of the Code of Good Practice mandates the undertaking of an investigation to determine if there are sufficient grounds for conducting a disciplinary hearing. (iii) Fair reason for termination accompanied by unfair procedure renders the dismissal order procedurally unfair.
