dc.description.abstractThe appellant, Isaya Simon Mpelumbe (now deceased) through his legal representative, one Mary Agnes Mpelumbe, an administratix of his estate, lodged the appeal to this Court against the decision of the High Court (Land Division) at Dar es Salaam in Land Case No. 89 of 2008. Pursuant to Rule 107 (1) of the Tanzania Court of Appeal Rules (the Rules),the respondent filed a notice of preliminary objection wherein she raised one point of law that:
