Abstract

This is an application for stay of execution of the decree of the High Court in Land Case No. 43 of 2013, pending the determination of Civil Appeal No. 259 of 2022. The Applicant moved the Court of Appeal of Tanzania under Rules 4 (2) (a) and (b) and 11 (3) of the Tanzania Court of Appeal Rules, 2009. The Applicant's grounds include ongoing developments by the 2nd and 3rd respondents on the disputed land, their alleged disregard for the appellate process, and their attempts to alienate the Applicant from the suit plot. Only the 2nd Respondent filed an affidavit in reply.
