When the appeal was called on for hearing, Mr. Galati, learned counsel for Charles Kaberuka, the respondent, submitted on the preliminary objection, notice of which had duly been given in terms of the provisions of rule 100 of the Court Rules, 1979 (hereinafter the rules).
