Abstract

In the High Court of Tanzania, Commercial Division, at Dar es salaam, the respondent filed a suit against the appellant. Consequently, the appellant filed a written statement of defence opposing the suit and raised a counterclaim against the respondent. The suit by the respondent was in the end resolved ex-parte against the appellant, following her failure to file witness statements for her three witnesses within 14 days of the completion of final pre-trial conference. As a result, the witness statements that were purportedly filed were struck out as per the ruling of the trial court dated 18lh February, 2022
