Abstract
John Nyakimwi, the applicant has by way of notice of motion moved the Court under rules 89(2) and 91(a) of the Court of Appeal Rules, 2009 (the Rules). It is sought to strike out a notice of appeal from the decision of the High Court sitting at Mwanza in Land Appeal No. 53 of 2010 made on 7th February 2014.
