dc.description.abstractThe respondent had filed a suit in the High Court - Commercial Division, against the applicant. It was Commercial Case No. 64 of 2008. Whether or not the applicant was served is a subject of contention between the parties but we would not go into that yet. What is apparent is that there was an application before the High Court for extension of time within which to file a written statement of defence under Order VIII Rule 1(2) of the Civil Procedure Code (the code).en_US
