N e y other system in facilitating gaming regulatory functionervs , government revenue assurance and in any other e mahntsn rer set out in the regulations or as specified by the Bll roi gard; “ A iag. ross gaming revenue” means collective amount of wagering an nz or staking placed by players minus the collective amount Ta of of winnings paid out to players; nt e “internet casino” means a game of chance or skill played for m ern money by using a remote device with internet connection; v G o “licence” means a gaming license, a manufacturer’s or 5 20 2 distributor’s license, a license issued to a disseminator of © information concerning racing or a license issued to an operator of an off-track pari-mutuel system; “licence fees” means any money required by law to be paid to obtain or renew a gaming license, manufacturer or 338 THE GAMING ACT [CAP. 41 R.E. 2023] distributor’s license or operator or retail gaming licence or a license issued to an operator of an off-track pari-mutuel system and includes the fees paid by a disseminator of information concerning racing; . “licensee” means a person to whom a valid licence has been OAG issued; of n “lottery” means and includes a sweepstake, a raffle and anissy io scheme or device for the sale, gift, disposal or distribuermp tion of any property depending upon or to be determoiun t ed by lot or chance, whether by the throwing or cast wini thg of dice d or by the withdrawing of tickets, cards, lobtsu t,e numbers or figures, or by means of a wheel, or othedriws trii se howsoever; “member” means a member of the Boarodr d appointed under section 5; ce du “Minister” means the Minister resproe onsible for finance; “national lottery” means a lo btet er ry scheme owned by the Government promoted comauy ntrywide as authorised by this Act for commercial puokbo rposes under an agreement with the Board; s th i “operation” means t f rht oe conduct of gaming activities or business; “operator’s licen cpae” means a licence issued under this Act authorising. N o ed a person to conduct gaming activities or businessesr; v e “operahttso rr of a slot machine business” means a person who, u ig ll rnder any agreement whereby consideration is paid or A ia. payable for the right to place slot machines, engages in n nz a the business of placing and operating slot machines upon Ta f the business premises of others; nt o e “Regulations” means a rule, standard, directive or statement ern m of general applicability which effectuates law or policy, ov G or describes the procedure or requirements for practicing 02 5 2 before the Board, and the term “Regulations” includes a © proposed regulation and the amendment or repeal of a prior regulations; “return of income” means a return of income of a person for a month and shall be in a manner and form prescribed 339 THE GAMING ACT [CAP. 41 R.E. 2023] specifying the person’s chargeable income for every month from each licensed gaming activity; “SMS lottery” means a lottery whose participation is by sending an SMS from a player’s mobile phone for purchase . of a lottery virtual ticket; G OA “slot machine” means any mechanical, electrical or other n o f device, contrivance or machine which, upon insertion osfiois a coin, token or similar object, or upon payment opfe rmany consideration, is available to play or operate, theo up t lay or operation of which, whether by reason of the skith w ill of the d operator in playing a gambling game whichut eb is presented for play by the machine or application do i isftr the element of chance, or both, may deliver or entitleo rt d he person playing or operating the machine to re c dcueeive cash, premiums, merchandise, tokens or anythipnroe g of value, whether the payoff is made automaticall ybe f rrom the machine or in any other manner; ay m “sports book” means the okbo business of accepting wagers on sporting events by is thany system or method of wagering; “to bet” means to wrta og f er or stake any money or valuable thing by or on behoa pl af of any person or, expressly or impliedly to underteadk . Ne, promise or agree to wager or stake by or on behsaelr vf of any person, any money or valuable thing on e a hhotsr rse race, or other race, fight, game, sport, lottery or e ig ll xr ercise or any other event or contingency; “ A iat.o urnament” means a series of contests; za n n “wager” means a sum of money or representative of value f T a o that is risked on an occurrence for which the outcome is nt e uncertain; ern m “winning” means the receipt of an amount of payment or ov G other consideration including a prize, award or reward 02 5 2 given by way of money, assets, goods or property in kind © to a person after having participated in a gaming activity recognised under this Act; and “withtholding agent” means a person required to withhold gaming tax on winning from a payment under this Act and remit the amount withheld to the Commissioner. 340 THE GAMING ACT [CAP. 41 R.E. 2023] PART II THE GAMING BOARD OF TANZANIA Establishment 4.–(1) There is established a Board to be known as the Gaming G. of Gaming Board of Tanzania Board of Tanzania which shall - O A (a) be a body corporate; of (b) have perpetual succession and a common seal; sio n is (c) in its corporate name be capable of suing and being rm p seued; t (d) be capable of purchasing or acquiring in anyth om u anner and alienating any movable or immovable dp wr ioperty; (e) be capable of entering into any contrr te ibauct as may be necessary or expedient for the perisft d ormance of its orfunctions. ed (2) The Board shall make procedudrue c o s for the conduct of its business. r re p y b e Composition 5.–(1) The Board shall be commpa osed of the following members: of Board (a) Chairman who shaokbo ll be appointed by the President upon recomme is thndation by the Minister; (b) three memabret orfs appointed by the Minister being - (i) a re Npo rpesentative of the Ministry of Finance; (ii) aed r . epresentative of the Attorney General; (c) twsoe r v e members appointed by the Minister who, in his tso rh pinion, possess the knowledge and experience in ig ll r gaming activities; and . A nia (d) one member from civil society appointed by the Minister. zan (2) The Director General shall be the Secretary to the Board. of Ta Manageemnte nt of 6. The powers to carry out the operations and management of Boa er rndm the gaming activities in Tanzania shall vest in the Board. ov G 02 5 Functions of 7.–(1) The Board shall perform the functions and exercise ©2 Board Act No. powers as are necessary for the carrying out of activities and 13 of 2019 s. 23 the doing of things as are necessary, advantageous or proper for promotion, protection and benefit of the gaming industry in Tanzania. 341 THE GAMING ACT [CAP. 41 R.E. 2023] (2) Without prejudice to subsection (1), the Board shall primarily oversee, monitor and regulate the conduct of gaming activities in Tanzania and in so doing it shall be responsible for– (a) the granting, issuing, suspending, withdrawing and . amending of gaming licence and any other licence G OA pertinent to the gaming activities; of n (b) advising on the imposition of taxes, levies and fees isisn io respect of any gaming activities and collection thpeer remof; (c) devising policy guidelines and setting nor t omu s and standards of conduct for lotteries and gaming th w i activities; d (d) fostering the stability and success of guateb ming and to preserve the competitive economy anddis f trriee competition; (e) bringing about honest and compde toi rt iveness in gaming industry; ce du (f) conducting a continuous espt ruody and investigation of gaming activities for th eb ep r urpose of ascertaining any defects in the rules anda y m regulations in order to discover abuses in administorob aktion and operations of the industry and to deal wit i st th hem; (g) exercising ortth o fer incidental powers as may be necessary to ensure a No psafe and orderly regulation of the industry includdi.e n g performing background checks of applicants, quaelrivs fications and registration thereof, approving re htsl icensees internal control procedures and testing of ig ll r gaming devices; A ia. (h) defining standards, principles and procedures in respect za n n of operations, premises, equipment, personnel, supplies Ta of procurement of services and enforcing compliance nt e therewith; ern m (i) developing mechanisms for stakeholders’ involvement v G o and measures for dealing with adverse social impact of 25 20 gaming activities; © (j) handling and determining complaints arising from gaming activities involving licensees and players; and (k) doing other things which are necessary for or in connection with the performance of its functions and powers or to enable it to discharge its duties. 342 THE GAMING ACT [CAP. 41 R.E. 2023] (3) The Board may delegate the performance or the exercise of its functions to the Director General. (4) Members of the Board shall be paid allowances from the funds of the Board at the rates as the Minister may determine. AG. Tenure of Board 8. (3i)g h t r A summons under this section shall specify the required ti.m A lel and manner of compliance. an ia z (4) The Board may require that any evidence referred to n Ta under this section be given on oath or affirmation, and in that of nt case, the Chairman, the Secretary or any member of the Board me rn may administer the oath or affirmation. veo (5) A person shall not be excused from complying with G 02 5 summons under this section on the grounds that, compliance ©2 may tend to incriminate the person or make the person liable to a penalty, save that information, documents and evidence provided in answer to a summons will not be admissible in any proceedings against the person other than proceedings under this Act. 343 THE GAMING ACT [CAP. 41 R.E. 2023] (6) A person who without lawful excuse refuses or fails to comply with a summons under this section, commits an offence and on conviction shall be liable to a fine not exceeding three hundred thousand shillings or imprisonment for a term . not exceeding fifteen months or to both. AG O (7) Where the Board has reason to believe that, a person is of n in possession or control of any documents that may assist it isisn io the performance of any of its functions, the Director Gepne remral or the Board may apply to the court for grant of a owu t arrant permitting the Board to enter into any premises at wrie thasonable d times to search or inspect the premises for dobcuu tements in the possession or under the control of the person tri dis and make copies of, or take extracts from those document r ds .o (8) A person who knowingly gidvue cse false or misleading information or evidence in purpporoe rted compliance with a summons under this section com r bemits an offence. (9) Where - ay m (a) the Board has aubot ohkorised a member or staff of the Board to enter tphisremises; and (b) the authorirst eo fd officer is refused or prevented from gaining en ptao ry to the premises, the magistra . Aia Power of n za 10.–(1) The Board shall, for the purpose of implementing its inspection, an seizure and f T functions, have powers to conduct inspection, gaming audit, o forfeituerne t seizure, forfeiture and destroying of unfit gaming device or Act N rnm o. 13e of 2019 s. 24 any other item related or connected directly or indirectly with ov G gaming activities. 02 5 (2) The Board shall, prior to exercising its power to forfeit ©2 or destroy under subsection (1), issue a notice in writing of its intention to forfeit or destroy the unfit gaming device or any other item related or connected with gaming activities. 344 THE GAMING ACT [CAP. 41 R.E. 2023] (3) Upon receipt of the notice referred to under subsection (2), the person served with the notice may, within seven days, provide the Board with reasons in writing as to why the unfit gaming device or any other item related or connected with . gaming activities should not be forfeited or destroyed. AG O (4) Where the person fails to provide reasons under f n o subsection (3) within the prescribed time or where the reasoinsss io provided are not satisfactory, the Board shall forfeit or depes rtmroy the unfit gaming device or any other item related or conutn o ected with gaming activities. ith ted w bu [s. 9A] i ist r Conflict of 11.–(1) A member and an employee of tohr de Board shall, for interest the purposes of ensuring public confidceeu ndce in the conduct of gaming activities, be in public trust d p. ro (2) A member and an employe erebe of the Board shall not - (a) have any interest, dimrae yc t or indirect in any licence, licensee, licensed p k ooremises, establishment or business involved in or w b hiist h gaming activities, which is licensed t by the Boardrt ;o fo r (b) receive aon py a gift, gratuity, employment or other thing for valu. Nd e from any person, corporation, association or firmers vtehat contracts with or that offers services, supplies, tsm r eaterials or equipment used by the Board in the normal l ri gh course of its operations. (3) A member or employee of the Board who contravenes za nthe provisions of this section commits an offence and on an f T conviction shall be liable to a fine of one million shillings or to nt o e imprisonment for a term not exceeding twenty-four months ern m or to both. ov G [s. 10] 02 5 ©2 Director 12.–(1) There shall be established an office of the Director General General. (2) The President shall, on recommendation of the Minister, appoint the Director General. 345 THE GAMING ACT [CAP. 41 R.E. 2023] (3) A person shall be appointed a Director General who has adequate knowledge and proven experience in the gaming industry. (4) The terms and conditions of service of the Director . General shall be as stipulated in the letter of appointment. (3) The waiver of confidentiality shall extend to any financial or personnel record, wherever maintained. [s. 29] 353 THE GAMING ACT [CAP. 41 R.E. 2023] Refusal of 32. A person who has an ownership interest of five percent or application for licence more in the person whose application has been refused- (a) by the Board may not reapply for a licence until at least one year has elapsed from the date of the refusal; . The Board may issue a permit or a license authorising the permit and n licence for publicz a promotion or conduct of public lottery for various purposes n lotteries of Ta namely– nt e (a) raising funds for social services, public welfare, relief of m ern distress or patriotic purposes; ov G (b) providing recreational or sporting facilities; 250 (c) promoting product awareness or for marketing purposes ©2 (promotional lotteries); and (d) doing other small lotteries as approved by the Board. [s. 37] 358 THE GAMING ACT [CAP. 41 R.E. 2023] Authorisation of 41.–(1) The Board may issue a permit authorising the public lotteries for charitable promotion and conduct of a lottery other than lottery promoted purposes or conducted under section 46, 47 or 48 which is intended to raise funds for social service, public welfare, relief and distress . or patriotic purposes or to provide recreational or sporting AG O facilities: of n Provided that, at least twenty-five per centum of the groissss io proceeds is to be devoted to the object for which the lottpee rmy is promoted. ut o (2) Notwithstanding subsection (1), the Board maithy require d w as a condition that, a specified proportion obfu tegreater than twenty-five per centum of the proceeds b i dies t rdevoted to the purposes for which the lottery is promootre d d, but in no case shall the Board require a proportion grecaedu ter than forty-five per centum of the gross proceeds. ro (3) Where in the case of a leo r ep b ttery authorised under this section less than twenty-fiv me a yper centum, or less than the proportion provided by tbhoe o kBoard under subsection (2), of the gross proceeds of the l is tohttery is devoted to the object for which the lottery is promrto ot fed or any of the proceeds are devoted to a purpose, otoh pe ar than expenses and prizes, which is not an object, eacdh. N e promoter of the lottery shall be construed as having comserm v itted an offence and on conviction shall be liable e to a finhets nr ot exceeding one million shillings or to imprisonment for a r igll term not exceeding six months or to both. [s. 38] nz a Powers of Bo aTraf d 42.–(1) The Board may, in respect of any authorisation granted with respnet cot to public under section 41- rnm leotteries (a) impose conditions as it may deem necessary in order ov e G to ensure that the lottery concerned is promoted and 5 02 conducted as efficiently as possible in the interests of ©2 the purpose for which it is being promoted and of the public in general; (b) take steps as it may deem necessary in order to ensure that any conditions imposed under paragraph (a) have been or are being complied with; and 359 THE GAMING ACT [CAP. 41 R.E. 2023] (c) guide and co-ordinate the proper and equitable distribution of the charitable funds of a lottery authorised by it. (2) Without prejudice to the generality of paragraph (a) of . subsection (1), the Board may, in respect of a lottery authorised AG O by it, impose conditions under that paragraph- n o f (a) providing for the amount, not exceeding twenty pisesr io centum of the gross proceeds of the lottery, whicher mp the promoters thereof may deduct from the procoue te ds in respect of operating expenses; ith d w (b) providing for the protection of purchasebur tse of tickets or chances in the lottery against fraud; tri dis (c) restricting the amount of the prdo oc re eds of the lottery which may be used for the dpuu cerposes of the lottery outside Tanzania, which eapm ro ount shall not exceed twenty per centum of th bee trotal amount devoted to the object for which the lmoay ttery is promoted; (d) relating to the probvoi oskion by the promoters of the lottery of guarantors tho ist cover the expected proceeds, or any part thereofr,t oo ff the lottery. (3) For the pur ppaoses of paragraph (a) of subsection (2), a fee paid in respect. oN o ed f the authorisation of a lottery shall be deemed to be part soerf v the operating expenses. re(4) htWs here any condition imposed under this section is con ig llt r avened, cash of the promoters of the lottery concerned, aian. (2) For the purposes of ensuring that, only a fit and proper body is granted a licence to run or promote the national lottery, 361 THE GAMING ACT [CAP. 41 R.E. 2023] the Board shall in relation to any application which may be submitted, vet applicants and in particular: (a) directors; (b) key gaming employees; . Aa society, being a society established and conducted wholly conducted for noia r mainly for one or more of the following purposes: charitable, z an sporting or T (a) charitable purposes; purposes t o of ther n (b) participation in or support of athletic sports or games rnm e or cultural activities; e ov (c) purpose which, not being described in paragraph (a) or 5 G 02 paragraph (b), are neither purposes of private gain nor ©2 purposes of a commercial undertaking; and (d) is so promoted for raising money to be applied for purposes of the society. 362 THE GAMING ACT [CAP. 41 R.E. 2023] (2) The following conditions shall be observed in connection with the promotion and conduct of the lottery: (a) the promoter of the lottery shall be a member of the society authorised in writing by the governing body of . the society to act as the promoter; OAG (b) a remuneration shall not be paid in respect of the of n lottery to the promoter or to any person employed by tih io sse promoter in connection with the lottery who carrieermp s on a betting business or is otherwise engaged by uwt o ay of business in the organisation of betting; th d w i (c) the whole proceeds, after deducting bsuu tems lawfully appropriate on account of expenses odris f troi r the provision of prizes, shall be applied to purpoor d ses of the society, being purposes described in padur caegraphs (a), (b) and (c) of subsection (1); proe (d) the amount of the procee dr b s appropriated on account of expenses shall nomta y exceed the expenses actually incurred, or fifteeno op k b er centum of the whole proceeds, whichever is th s the i less, and the amount of the proceeds appropriated f rt ofor the provision of prizes shall not exceed one-half o pfa the whole proceeds; (e) the pric. eN o ed of each ticket or chance shall be the same, and these pr vrice of a ticket shall be stated on the ticket; e (f) r htsa written notice or advertisement of the lottery shall g ll r i not be exhibited, published or distributed except - A ia. (i) a notice or advertisement exhibited on the premises n nz a of the society, or published or distributed exclusively of Ta to members of the society; t en (ii) the notice or advertisement as may be contained rnme in the tickets, if any; v G o (g) a ticket, notice or advertisement of the lottery lawfully 02 5 2 exhibited, distributed or published shall specify the © name of the society, the name and address of the promoter and the date on which the draw, determination or event by or by reference to which the prize winners are ascertained will take place; 363 THE GAMING ACT [CAP. 41 R.E. 2023] (h) a ticket shall not be sent through the post to a person not being a member of the society; (i) a person shall not be admitted to participate in the lottery in respect of a ticket or chance except after . payment to the promoter of the whole price of the ticket G OA or chance, and no money received by the promoter of n for or on account of a ticket or chance shall in a io inssy circumstances be returned; and rm pe (j) a payment on account of expenses or prizes shaolul t not be made out of moneys of the society other thawnit hproceeds d of the lottery. uteb (3) Where any condition required by dsisu tribsection (2) is contravened, the promoter of the lottery anor d d any other person who is a party to the contravention codm e ucmits an offence and on conviction shall be liable to a fine nporoe t exceeding two hundred thousand shillings or imprisonm r beent for a term not exceeding six months or to both. may (4) For the purposes bo k ofo subsection (3)- (a) it shall be a d the isf ence for a person charged with an offence unde f rt ro this section only by reason of his being the promoo pt aer to prove that, the contravention occurred withoud.t N his consent or connivance and that he exercised du rve see diligence to prevent it; e (b) htsi tr shall be a defence for a person charged with an l ri g l offence in respect of an appropriation or payment made ia. A in contravention of paragraph (e) or paragraph(l) of za n n subsection (2) to prove that - a of T (i) the proceeds of the lottery fell short of the sum nt e reasonably estimated; ern m (ii) the appropriation or payment was made in respect ov G of expenses actually incurred, or in order to fulfil 25 20 an unconditional undertaking as to prizes given © in connection with the sale of the relevant tickets or chances; and 364 THE GAMING ACT [CAP. 41 R.E. 2023] (iii) the total amount appropriated or paid in respect of expenses and prizes did not exceed the amounts which could lawfully be appropriated out of the proceeds of the lottery under subsection (2)(e), . where the proceeds had amounted to the sum OAG reasonably estimated. of n (5) In this section- siois (a) in construing subsection (1)(c), a purpose for whpei rcmh a society is established or conducted which is caluct o ulated to benefit the society as a whole shall not be w ih theld to be d a purpose of private gain by reason only te bu that action in its fulfillment would result in benefidt t troiis any person as an individual; or d (b) in construing subsection (2)(d),c edu where a payment falls to be made by way of hireipn rog, maintenance or other charge in respect of equ ibpe mr ent for holding the lottery and the amount of t hmaaty charge falls to be determined wholly or partly byokbo reference to the extent to which that or some otthhise r equipment is used for the purpose of that lotte f rrt oy, then that payment shall be held to be an applica ptao ion of the proceeds for purposes of private gain, adn. N e d accordingly the reference to expenses shall noste ri vnclude a reference to any charge falling to be so re htsd etermined; and ( g llc ri) “society” includes a club, institution, organisation or . Aia association of persons, by whatever name called, and an nz any separate branch or section of that club, institution, of Ta organisation or association. nt e [s. 44] rnme G oEvxemption to 48.–(1) A lottery may be promoted or conducted as an incident 5 small lotteries 02 incidental of an entertainment to which this section applies provided ©2 to certain the following conditions are observed in connection with the entertainment promotion or conduct of the lottery– (a) the whole proceeds of the entertainment (including the proceeds of the lottery) after deducting- 365 THE GAMING ACT [CAP. 41 R.E. 2023] (i) the expenses of entertainment excluding expenses incurred in connection with the lottery; (ii) the expenses incurred in printing tickets in the lottery; and . (iii) sum, if any, not exceeding one hundred thousand AG O shillings as the promoters of the lottery think fit f n o to appropriate on account of expenses incurred io ibssy them in purchasing prizes in the lottery, shpael rlm be devoted to purposes other than private gaoiun t : Provided that, the proceeds of the entertainmen tw, i tihncluding d the proceeds of the lottery, shall not be held tob ub tee devoted to purposes of private gain by reason only that, i s ttrheir application for purposes other than private gain resultoer di d d in benefit to any person as an individual; ce du (b) tickets or chances in the lotteerpy ro shall not be sold or issued, nor shall the result of the b elo r ttery be declared, except on the premises on whi cmhay the entertainment takes place and during the prboog okress of the entertainment; (c) the facilities p thr ios vided for participating in lotteries, or those facrti loi fties together with either or both of the followingo: p a (i) feadc . Nilities offered for gaming entertainment not ervs held for private gain; e hts( iri) the opportunity to win prizes at amusements ig ll r with prizes at certain non-commercial A ia. entertainments, shall not be the only, or the only an nz substantial, inducement to persons to attend the of Ta entertainment; nt e (d) the prizes in the lottery shall be in the possession and ern m custody of and at the disposal of the promoters of the v G o lottery; 5 20 2 (e) there shall not be exhibited, published or distributed © a written notice or advertisement of the lottery, other than a notice thereof exhibited on the premise on which the entertainment takes place and the announcement 366 THE GAMING ACT [CAP. 41 R.E. 2023] or advertisement thereof as is contained in the tickets, if any; (f) none of the prizes in the lottery shall be money prizes; and . (g) a ticket or chance shall not be sold at a price. OAG (2) Where any of the conditions specified in subsection n o f (1) is contravened, a person concerned in the promotion iossr io conduct of the lottery shall be deemed to have committpeed rm an offence and on conviction shall be liable to a fine not exocu te eding five hundred thousand shillings or to imprisonmentw i fthor a term d not exceeding six months or to both. uteb (3) It shall be a defence for a person chargdesd trii with an offence under this section to prove that, the contorr d avention occurred without his consent or connivance andud c ethat he exercised due diligence to prevent it. ro ep (4) The entertainment to w bhe irch this section applies are bazaars, sales of work, feems,a ydinners, dances, sporting or athletic events and other be k ono tertainment of a similar character, whether limited to on is teh day or part thereof or extending over two or more days. of pa rt o [s. 45] d. N e Private lotteries 49.–(1) As epr vrivate lottery may be promoted and conducted providetsd r e the following conditions are observed in connection withl r itgh h e promotion and conduct of the lottery: . A l ia (a) the whole proceeds, after deducting only expenses n za incurred for printing and stationery, shall be devoted an f T to the provision of prizes for purchasers of tickets or t o en chances, or, in the case of a lottery promoted for the ern m members of the society, shall be devoted either to the ov G provision of prizes or to purposes which are purposes 02 5 of the society, or, as to part to the provision of prizes ©2 and, as to the remainder, to purposes of the society; (b) there shall not be exhibited, published or distributed a written notice or advertisement of the lottery other than - 367 THE GAMING ACT [CAP. 41 R.E. 2023] (i) a notice thereof exhibited on the premises of the club for whose members it is promoted or, as the case may be, on the premises on which the persons for whom it is promoted work or reside; . (ii) announcement or advertisement thereof as is AG contained in the tickets, if any; of O n (c) the price of each ticket or chance shall be the same, anissd io the price of a ticket shall be stated on the ticket; ermp (d) a ticket shall bear upon the face of it the namute o s and addresses of each of the promoters of the lo wtti tehry and a d statement of the persons to whom the saulteeb of tickets or chances by the promoters is restricteddis, t rai nd a statement that no prize won in the lottedr oy r shall be paid or delivered by the promoters tod ua ceny person other than the person to whom the wienp rno ing ticket or chance was sold by them, and a priz eb es rhall not be paid or delivered except in accordance mw aiyth that statement; (e) a ticket or chanceb os ohkall not be issued or allotted by the promoters exc e s thpi t by way of sale and upon receipt of the full pricret ot fhereof and a money or valuable thing so received ob py a a promoter shall not in any circumstances be ret . eudr Nned; and (f) a ticerkvs et in the lottery shall not be sent through the post. (2) Wts r e h here any of the conditions specified in subsection (1) is coll rni gtravened, a promoter of the lottery, and where the person biay. (i) members of one society established for social or AG O recreational purposes only; or of n (ii) persons of whom work on the same premises; oisrs io (iii) persons of whom reside on the same premerimp ses, and which is promoted by persons each oofu tw hom is a person to whom, under subpara t wgir haphs (a) d (ii) and (iii), ticket or chances mayb ub tee sold by the promoter and, in the case of a dlios ttritery authorised in writing by the governing bord d y of the society to promote the lottery; uc e d (b) “society” includes a club, inprsoe titution, organisation or other association of pers r boens by whatever name called, and each local or affil i y maated branch or section of a society shall be regarded baos o ka separate and distinct society. is th [s. 46] rt o f Prohibition for 50.–(1) A ticket oo rp achance in a lottery promoted and conducted sale of ticket by or to person under under this Padr.t N shall not be sold by or to a person under the eighteen years age of eighsetre veen years. (2) tIs nr e the case of a contravention of this section, the prom h l ri goters of the lottery concerned, and where the person by. A l ia whom this section is contravened is not a promoter that anz person also, commits an offence and on conviction shall be an f T liable to a fine not exceeding three hundred thousand shillings t o en or to imprisonment for a term not exceeding three months or m ern to both. Gov (3) It shall be a defence- 02 5 (a) for a person charged with an offence under this section ©2 only by reason of his being a promoter of the lottery to prove that the contravention occurred without his consent or connivance and that he exercised due diligence to prevent it; 369 THE GAMING ACT [CAP. 41 R.E. 2023] (b) to prove that the person charged neither knew nor had reasonable cause to suspect that the person was under the age of eighteen years. [s. 47] . AG Submission of 51.–(1) The Board may require the promoters of a lottery of O accounts and returns in respect which is promoted, or conducted under sections 46, 47 and 48io nss of lotteries to submit accounts and make returns in a form and witherimn i a period as it may specify. t p ou (2) A person who - ith w (a) makes default in submitting account d uste or making returns required to be submitted or rib ismt ade under this section within the time specified; oorr d (b) submits accounts or makes a retcueu rdn which he knows or may be reasonably considerperdo d to know to be false in a material particular, e be r commits an offence and on co y mnavi ction shall be liable to a fine not exceeding five hundred th k ooousand shillings or to imprisonment for a term not exceedin b higs three months or to both. of t rt [s. 48] o p a Certain 52.–(1) A perds.o Nn shall not- prohibition in relation to (a) selle, rvo effer to sell, expose for sale, print, distribute or unauthorised ss er ensd to another person any lottery ticket in respect of lotteries t igh an unauthorised lottery; or A(ll r . b) conduct or manage an unauthorised lottery. ia za n (2) A person who contravenes any of the provisions of an T subsection (1), commits an offence and on conviction shall be f nt o liable to a fine not less than one million shillings. e rnm [s. 49] ov e G 25 Control of 53.–(1) A person shall not print or publish or cause to be 20 advertisement © relating to printed or published any advertisement of or relating to an lotteries unauthorised lottery, or relating to the issue of any lottery ticket or the amount or nature of any dividend or prize connected with an unauthorised lottery. 370 THE GAMING ACT [CAP. 41 R.E. 2023] (2) Subsection (1) shall not apply to the publication of any advertisement in a newspaper printed outside Tanzania normally circulating within Tanzania. (3) A person who contravenes the provisions of subsection . (2) The licensoe p aissued under this section shall be valid for a period of sidx. Nmonths from the date of issue, and may, upon applicatiosne rb vey the license holder, be extended by the Board for a furthtesr r eperiod not exceeding twelve months in aggregate. (l3 ri)g hThe Board may, in consultation with the Minister, make l r A iau. les prescribing fees and levies that may be paid in respect of za nany gaming activities under this section. an f T [s. 51] t o men ern PART VII v 5 G o AMUSEMENTS WITH OR WITHOUT 2 20 PRIZES AND MONEY GAMES © Provision of 55.–(1) A person may provide amusements with or without amusements with prizes prizes at commercial or non-commercial entertainments as may be authorised and licenced by the Board. 371 THE GAMING ACT [CAP. 41 R.E. 2023] (2) For the purposes of subsection (1), the following conditions shall apply: (a) the whole proceeds of the entertainment including the proceeds of any amusements to which this section . applies, after deducting - OAG (i) the expenses of the entertainment, including expense n o f incurred in connection with any amusements; io iss (ii) sum, if any as the person providing the amusemeremp nts thinks to be appropriate account of eoxup t enses incurred in purchasing prizes in conne wcitthions with d any amusement, the remainder shalblu b tee considered and treated as private gain; ri dis t (b) the opportunity to win prizes at adm o ru sements to which this section applies, or that op c dpu oertunity together with facilities offered by virtue of psreoe ction 46 and the manner for participation in a lot r btery or taking part in gaming, shall not be construed y k m aas being the only inducement to persons to attend btoh oe entertainment. (3) Where any of th is the conditions specified in subsection (1) is contravened or n oofrt t complied with, a person concerned in the provision oro cp aonduct of that amusement shall, unless he proves that, tehde . N contravention occurred without his consent or connivancers vand that he exercised due diligence to prevent it, e commhittss r an offence and on conviction shall be liable to a fine not exc ig lel reding three hundred thousand shillings or imprisonment f A iao. r a term not exceeding three months or to both. za n n (4) In this section - of Ta (a) in construing paragraph (a) of subsection (1), the nt e proceeds of the entertainment shall not be held to be m ern applied for purposes of private gain by reason only Gov that, their application for purposes other than private 25 20 gain resulted in benefit to any person as an individual: © Provided that, where a payment falls to be made by way of hiring, maintenance or other charge in respect of any equipment for providing the amusements and the amount of that charge falls to be determined wholly or partly by reference 372 THE GAMING ACT [CAP. 41 R.E. 2023] to the extent to which that or some other equipment is used for the purpose of the amusements, then the payment shall be held to be an application of the proceeds for purposes of private gain, and accordingly, the reference to expenses shall not . include a reference to any charge falling to be so determined; AG O (b) “entertainment” means a bazaar, sale of work, fete, dinner, n o f dance, sporting or athletic event or other entertainme io isnst of similar character whether limited to one day o rm pre part thereof or extending over two or more days. ou t ith w [s. 52] d ute Amusements 56.–(1) The Board may, subject to any regulatitoribis ns made under machine this Act, and upon grant of a licence, issue aor pdermit authorising the use of an amusement machine on pcreedmises approved by it. (2) A permit issued under this sreod u p ction shall be subject to conditions as the Board may im re bpe ose and in every case to the condition that, where the am y mua sement machine is placed in a premises ordinarily restrictek o d for children, a person under the age of eighteen years sihs b o h all not play an amusement machine unless in the presenc oef t rt of, and with the permission of his parent or guardian. o p a (3) A persod.n N who - (a) usesesr voer permits the use of an amusement machine in re tsr espect of which a permit has not been issued under h l ri g subsection (1); or l a. A i (b) contravenes or allows the contravention of any condition anz provided for or imposed by the Board under subsection (2), n f T a commits an offence and on conviction shall be liable - nt o e (i) in the case of an offence under paragraph (a), to a rnme fine not exceeding five hundred thousand shillings v G o or to imprisonment for a term not exceeding six 25 months or to both; and ©20 (ii) in the case of an offence under paragraph (b), to a fine not exceeding two hundred thousand shillings or to imprisonment for a term not exceeding two months or to both. 373 THE GAMING ACT [CAP. 41 R.E. 2023] (4) In this section, “amusement machine” means a machine other than a gaming machine - (a) which is operated by the insertion of a coin or coins into the machine; and . (b) whereby a successful player neither receives nor is offered G OA any benefit other than - of n (i) the opportunity afforded by the automatic actiosniois of the machine to play the game again wipteh rmout insertion of a coin; or t ou (ii) the delivery by the machine of a coin o wr itchoins of a d value not exceeding that required ibnu t eorder to play the game once. ist ri d d o r [s. 53] ceu Prohibition 57.–(1) A person shall not conduct d pirno Tanzania, in or through against competitions or any newspaper or broadcasting, b oe rre in connection with a trade prizes involving or business or the sale of any y m aarticle to the public- no skill (a) a competition in wooh ki ch prizes are offered for forecasts of the result eithise bh r or a future event, or of a past event t the result orft ow f hich is not yet ascertained or not yet generally a o kpnown; (b) any odt.h Ner competition success in which does not de rve speend to a substantial degree upon the exercise of s krets ill. (l2 ri)g h The provision of subsection (1), in respect to the l cao. A i nducting of competitions in connection with a trade or anz business, shall not apply in relation to a pool betting scheme. an f T (3) A person who contravenes this section, without prejudice t o en to his liability, if any, to be proceeded against under any other ern m provision of this Act relating to betting and lotteries commits an ov G offence and on conviction shall be liable to fine not exceeding 02 5 three hundred thousand shillings or to imprisonment for a ©2 term not exceeding three months or to both. 374 THE GAMING ACT [CAP. 41 R.E. 2023] (4) In this section, “broadcasting” means radio communication which is intended and capable of being received by members of the public. [s. 54] . AG Prohibition of 58.–(1) A person who sends or causes to be sent or supplies of O money games, n o pyramid and or cause to be supplied or delivers or cause to be delivered an i ssy other similar chain letter or voucher or “upatu” or who sends or rec i eerimves schemes money or moneys worth in connection with a chain olue tt pter or voucher commits an offence and on conviction sh awlil th be liable to a fine not exceeding five hundred thousanudte dshillings or imprisonment for a term not exceeding five yisetra ibrs or to both. (2) A person who, in relation to a d nory gaming activity, conducts or promotes or is a party tuoce dany scheme, plan or operation of any kind by which paro dperson, on payment of money or on giving any valuabel er e b security becomes entitled under the scheme, plan or opmer ayation to receive from the person conducting or promoting tkh oo e scheme, plan or operation, or any other person, a larghe b isr sum of money or amount of valuable t security than the surt mo f or amount paid or given, or to be paid or given by reaso npao of the fact that, other persons have paid or given, or oblig N d.e d themselves to pay or give any sum of money or valuabler vese security under the scheme, plan or operation, committss r ean offence. ( h ll 3 ri)g A person who- a. A i (a) makes any payment to or for the benefit of the promoter n za or any promoters, or to or for the benefit of a participant n f T a in the scheme or plan; and t o en (b) is induced to make that payment by reason that, the ern m prospect is held out to him of receiving payment or v G o other benefit in respect of the introduction of other 02 5 persons who becomes participants in the scheme ©2 or plan, commits an offence. [s. 59] 378 THE GAMING ACT [CAP. 41 R.E. 2023] Requirement for 63.–(1) A licensee shall create and keep accurate, complete, record keeping legible and permanent records in order to ensure compliance with this Part. (2) The records shall be kept in a manner as the Board may . instruct, direct, approve or require. A cheating or thieving game or device; or nia za (b) knowingly deal, conduct, carry on, operate, or expose n Ta for play any game or games played with cards or any nt of mechanical device, or any combination of games or e rnm devices, which have in any manner been marked or veo tampered with or placed in a condition or operated 5 G 02 in a manner the result of which tends to deceive the ©2 public or tends to alter the normal random selection of characteristics or the normal chance of the game which could determine or alter the result of the game. 384 THE GAMING ACT [CAP. 41 R.E. 2023] (2) A person issued a licence pursuant to this Act who contravenes this section commits an offence and on conviction shall be liable to a fine of not less than one million shillings or to imprisonment for a term not exceeding three months or to both. (3) A re ts person who contravenes the provisions of this section coml rmig hits an offence and on conviction shall be liable to a fine l n A iao. t exceeding five million shillings or to imprisonment for a za nterm not exceeding two years or to both. Aia a gaming device in a manner contrary to the designed za n n and normal operational purpose for the component, a of T including, but not limited to, varying the pull of the nt e handle of a slot machine, with knowledge that, the rnme manipulation affects the outcome of the game or with Gov knowledge of any event that affects the outcome of the 02 5 2 game; © (h) by any trick or slight of hand performance, or by fraud or fraudulent scheme, cards, or device, for himself or another, win or attempt to win money or property or a representative of either or reduce a losing wager or 386 THE GAMING ACT [CAP. 41 R.E. 2023] attempt to reduce a losing wager in connection with gaming; (i) conduct any gaming operation without a valid licence; (j) conduct any gaming operation on an unlicensed . premises; OAG (k) permit any gaming activity to be conducted, operated, n o f dealt, or carried on in any gaming premises by a persosniois other than a person licensed for premises pursua rm pent to this section; t ou (l) place any gaming devices or slot machine ws ithinto play d or display the devices or slot machin te beus without the authorisation of the Board; str i di (m) employ or continue to employ andy o p r erson in a gaming operation who is not duly licdeun cesed or registered in a position whose duties requeipr reo a license or registration pursuant to this Act; or r be (n) without first obtaining ay m the requisite license or registration pursuant to this secbot oiok n, be employed, work, or otherwise act in a positio tnh is whose duties would require licensing or registratio nofrt pursuant to this Act. (2) A person ow p aho contravenes subsection (1), commits an offence and oend . cNonviction shall be liable to a fine not exceeding five hundr rv sed thousand shillings or to imprisonment for a term e not exhctse er ding twelve months or to both. l ri g l [s. 77] A nia . [s. 78] . A to any betting transaction, lottery or gaming as may anz be reasonably required by him in the performance an f T of his duties. t o en (2) The power to act under subsection (1) shall only be ern m exercised without warrant where the person so acting has ov G reasonable cause to believe that the delay occasioned in 250 obtaining a search warrant would seriously hinder him in the ©2 performance of his duties, and the power shall be exercised only by or under the directions of a police officer of or above the rank of Assistant Inspector unless the person authorised in writing by the Board has reasonable cause to believe that, 388 THE GAMING ACT [CAP. 41 R.E. 2023] the delay occasioned in summoning a police officer would, or would tend to, defeat the purposes of this section. (3) A person who resists, hinders or obstructs a person acting in pursuance of any of the provisions of this section, or . who on a requisition under subsection (1) wilfully withholds OAG information, or gives information knowing or having reason of n to believe it to be false or misleading commits an offencseiois and on conviction shall be liable to a fine not exceedinpge rmfive hundred thousand shillings or to imprisonment for a teurt o m not exceeding six months or to both. ith d w (4) Before removing anything under subsbeuc tetion (1), the person removing it, shall furnish the person ri diisn t whose custody or possession the article is at the time of red mo r oval with a written receipt thereof. e uc pro d re [s. 79] be Forfeiture of 84.–(1) Where a licencee is cmony a victed of an offence under this licence Act or of an offence invoolvo ki ng fraud or dishonesty, the court by or before which that sp bhi erson is convicted may order that his t licence be forfeited ro t or f cancelled. (2) Where a lic peao nce is forfeited or cancelled in pursuance of an order madde. Nunder subsection (1), a licensee shall, by virtue of that orsdrevee r, be disqualified from holding or obtaining a licencet so rr e a further licence for a period of five years beginning on thigehl r date of the conviction which gave rise to the order. l A ia. (3) A licencee or an agent of a licencee who employs in n za his business, any person whom he know to be disqualified in n f T a accordance with subsection (2), commits an offence and on t o en conviction shall be liable to a fine of not less than five hundred rnme thousand shillings. v G o (4) A bookmaker, promoter of a pool betting scheme or 250 organiser or manager of licensed gaming premises, or a servant ©2 or agent of his, who employs in his business any person known to him to be disqualified commits an offence and on conviction 389 THE GAMING ACT [CAP. 41 R.E. 2023] shall be liable to a fine of not less than two hundred thousand shillings. (4) Monies found in the gaming device and gaming system used in illegal operation pursuant to this section shall be seized . by or forfeited to the Board.
