Aia or vapor, or 2 milligrams per liter or less of mist, fume za n n or dust, when administered by continuous inhalation Ta of for 1 hour (or less if death occurs within 1 hour) to nt e albino rats weighing between 200 and 300 grams each; rnme “International Convention” means a convention, agreement ov G or other scheme that have been ratified or acceded to by 02 5 2 the Government; © “inspector” means an inspector appointed under section 37 of this Act; “industrial chemical” means any chemical or product used or intended for use in industrial process; 66 THE INDUSTRIAL AND CONSUMER CHEMICALS ACT [CAP. 182 R.E. 2023] “label” means a written, printed or graphic matter on, or attached to the chemical or the immediate container thereof and the outside container or Wrapper of the retail package of the chemical; . “LD50” or “(lethal dose 50)” means an amount of a substance OAG that, when administered by a defined route of entry (for of example oral or dermal) over a specified period of timesio n is , is expected to cause the death of 50 percent of a defierp nmed animal population; ut o “management” means handling, supply, transport, i wstthorage, or d other use of a chemical subsequent to its initibaul t emanufacture or formulation, in a manner that minimi tri dzises risk to human health or the environment; or d “make good” means to restore the siteu cd teo condition and state which is as close as possible to ro e pits original state before it was used for the purpose of sbet or rage, producing or dealing in chemicals; may “Minister”, means the oMo k b inister responsible for matters relating to chemic s athl is management and control; “Ministry” means f rt tohe Ministry responsible for chemicals managemento apn a d control; “Precursors edC . Nhemicals” means Chemicals used in the manufascert vuring of narcotic drugs or psychotropic substances reas hptsrovided for under the International Drug Control C roigll nvention; “iap. Aremises” means any land, shop, stall, warehouse or place an nz where any chemical is produced, sold, stored or used; of Ta “prior informed consent” means the principle that a chemical nt e which has been banned or severely restricted for health rnme or environmental reasons in one country should not v G o be exported to countries participating in the procedure 25 20 without their prior informed consent; © “producer’” means a person or other entity in the public or private sector or any individual engaged in the business or function whether directly or through an agent or through an entity controlled by or under contract with it, of preparing, mixing or producing a chemical; 67 THE INDUSTRIAL AND CONSUMER CHEMICALS ACT [CAP. 182 R.E. 2023] “prohibited chemical” means a chemical whose use is banned; “public officer” means a person or Department vested with or performing duties of a public nature, and includes a person under the control of a local government authority, . the community or a public corporation or authority; OAG “reference laboratory” means a laboratory appointed by n o f the Minister under section 42 to carry out analysis fiossr io the purpose of authenticating results of the desigpnea rmted laboratory under this Act; ut o Registrar” means the Registrar appointed under se ith d w ction 9; “registration” means an inclusion into thuet eb register of chemicals, certificate holders or premise i dis t;r “restricted chemical” means a limited b r da on of a chemical for which virtually all registered usedsu che ave been prohibited by the Board but certain spec ro eipfic registered use or uses remain authorised; r be “risk assessment” means ana y m act of assessing the risk of exposure and adversbe k o oeffect to human health and the environment; is th “risk management f rt” o means a process and procedure of reducing or poo ps asibly eliminating risks associated with the exposure etdo . No. (2) Registration of a chemical may be applied for by- 386 of 2012 (a) the producer of the chemical; (b) the dealer of chemical; 73 THE INDUSTRIAL AND CONSUMER CHEMICALS ACT [CAP. 182 R.E. 2023] (c) the marketing firm, if the chemical is to be marketed for the first time in Mainland Tanzania; or (d) the importer and exporter of that chemical. (3) The application shall be accompanied by a fee prescribed . by the Minister in the regulations. OAG (4) An application for registration of a chemical shall of n contain- siois (a) the name and address of the applicant; pe rm (b) the hazardous category of the chemical substan t ouce ; (c) the details of its composition, particularly wtih the nature d and quantity of its ingredients, using btuh tee commonly employed scientific nomenclature; ri dis t (d) the details of the intended use; d o r (e) the details on its possible dangdeur cse to human health and the environment; proe (f) the details of procedurees r b for its proper disposal or treatment; ay m (g) the instructions fo ok bor safe handling; (h) the text of indicisa th tions and marking intended for the containers artn o fd outer packaging or for the literature accompa a on pying such packaging; (i) the de . edta Nils of the packing materials; and (j) thes eri vnformation on suitable analysis procedures which re htscan be carried out using commonly employed equipment g ll r i at a reasonable cost and which can also be used to reliably ia. (6) Notwithstanding the provisions of subsection (1), the Board shall not approve the registration of any chemical unless it conforms to the requirements as laid out in this Act. 74 THE INDUSTRIAL AND CONSUMER CHEMICALS ACT [CAP. 182 R.E. 2023] (7) As soon as possible after receiving an application in terms of subsection (1), the Chief Government Chemist- (a) shall notify the applicant that the application has been so received; . (b) shall conduct such investigation or inquiry as he OAG considers necessary or desirable, including analysis of of n samples; io iss (c) may require further particulars or samples fromr pe mthe applicant; and t ou (d) shall submit report and recommendations for ith wapplication d together with the chemical particulars to tuhteb e Committee there after to be forwarded to the Boartdridis . (8) An application in terms of subsecd toi ro n (1) may, at any time, be withdrawn by the applicant b e duu ct such withdrawal shall not entitle the applicant to the refpuroe nd of the application fee referred to in subsection (3). e r b (9) The chemicals that appay m ear under the Third and Sixth Schedule shall require regbois oktration. A l provisional ia plication submitted in accordance with section 11 and if he is clearance or anz satisfied after such inquiry, investigation, test or analysis of the rejections of Tan application f chemical as he deems fit, approve registration of the chemical, nt o e provisionally clear the chemical or reject the application. m ern (2) Upon approval for registration or provisional clearance Gov of the chemical, the Chief Government Chemist shall issue a 02 5 certificate, and assign a registration number. ©2 (3) In making his decision under subsection (1), the Chief Government Chemist shall be guided, among other considerations, by whether- (a) all matters submitted with the application are true in all material particulars; 76 THE INDUSTRIAL AND CONSUMER CHEMICALS ACT [CAP. 182 R.E. 2023] (b) the label complies with provisions of this Act; (c) the chemical which is subject of the application has not been registered before; (d) the chemical does not cause adverse effects to human . life and the environment when applied in accordance G OA with instructions for use; and of n (e) the use of the chemical has not been restricted or bann io iessd in other countries by International Conventions, Trpeea rmties or Agreements whether ratified or not. ut tho w i Application 15.–(1) An application for the registration oft eda producer, for registration u of producer, importer, exporter, transporter, storage and deiastlri ibng in chemicals importer and shall be submitted to the Registrar in theo rp drescribed manner exporter etc. and form, as set out in the Fourth Schedcedu ule. (2) Registration may be appliedp rfo dr by- (a) the producer; e r e b (b) the marketing firm; o y mra (c) those intending to k o iomport, export, transport, store and deal in chemicahlis ,b t in respect of a chemrt oi fc al appearing under the Third Schedule if its amount exco epe ads the threshold value specified therein in the purchase dr.e Nceipt. (3) Ans ear vpeplication for registration under subsection (1) shall intsc lr eude- (la ri)g h the name and address of the applicant; Al ia. (b) details of the intended business; and n za (c) qualifications of personnel under whose direct n f T a supervision the activities will be carried out. t o en (4) Notwithstanding the provisions of subsection (1), the ern m Board shall not approve any application for registration unless ov G it conforms to the requirements as laid out in the guidelines for 02 5 registration and any other conditions prescribed by the Board. ©2 (5) An application in terms of subsection (1), may, at any time, be withdrawn by the applicant. (6) A  person giving false information in an application, commits an offence. 77 THE INDUSTRIAL AND CONSUMER CHEMICALS ACT [CAP. 182 R.E. 2023] (7) Information submitted to the Registrar under this section shall be confidential. General 16. The application for producing, warehousing, exporting, requirements of dealers in importing, transporting or dealing in chemicals shall contain- AG. chemicals (a) the description of premises on which the chemicals of O will be stored, produced and marketed; sio n s (b) the equipment and facilities which are availableer mf ior distributing, handling, producing, processinoug t ,p and transporting chemicals from those premise sw;i th (c) the qualifications of the personnel underut ew d hose direct supervision those operations will be csatrr ib i ried out; (d) the arrangements made or to be mr do ade for the safety, health and the environment w d uciethin and outside the premises; d pro (e) contingency plans and bperreocedures for dealing with emergency; and y ma (f) the arrangements m oo kade or to be made for securing the safety keeping ohfis abnd maintenance of adequate records t in respect of ocf rt hemicals stored in or distributed from those preom p aises. d. N Requirements 17. Notwitehrvs etanding section 15, where an application is for for producers registrast ir eosn for production of chemicals, the Board, before appr ht roigving issuance of the certificate of registration to which th. eA llapplication relates shall consider whether- nia za (a) the Goods Manufacturing Practice (GMP) is complied Tan with; nt of (b) the production processes are within premises registered e rnm for such activities; e ov (c) the Environmental Impact Assessment (EIA) and 5 G 02 Environmental Management Plan certified by the ©2 designated national environment authority has been carried out; (d) the Emergency Management Plan has been approved by the Board or any other relevant authority; and 78 THE INDUSTRIAL AND CONSUMER CHEMICALS ACT [CAP. 182 R.E. 2023] (e) adequate measures have been taken to prevent or minimize harm to human beings and the environment, including adequate waste treatment facilities and environmentally sound processes. AG. Requirements for 18. Notwithstanding section 16, where an application is for f Oo storage and ware- n o housing registration for storage and warehousing, the Board, befo is rsei approving issuance of the certificate of registration to wehrmich the application relates shall consider the following- t p ou (a) the storage or warehouse facility is construicth w ted with sufficient interior space, well ventilated uaten d d provided with adequate fire fighting equipme r instt i bin accordance with the approved national, interonr d ational or foreign standards; d uc e (b) availability of utilities neede d pdro in emergencies; (c) availability of trained perbse orennel; (d) the storage or warehou y msae is not accessible by unauthorised persons; oo k (e) the storage or whaisr behouse is constructed and maintained t in such a woaf rt y that risks of human exposure and environmo pe antal contamination and poisoning are avoide N dd. ; (f) thes esr vteorage or warehouse is well marked with warning tss irg e ns; and the chemicals shall be stored in their original h ll r ig containers. . Aa Registration n1iza 9.–(1) The Board after receiving an application in terms of procedures n of Ta section 15- nt (a) shall conduct an investigation or inquiry as it considers rnm e necessary or desirable, including hearing evidence ov e from the applicant, the public or any other competent G 02 5 person; and ©2 (b) may require further particulars from the applicant. (2) Where the Board- (a) approves the registration of any importer, exporter, producer, transporter or dealer of chemicals, the Registrar shall- 79 THE INDUSTRIAL AND CONSUMER CHEMICALS ACT [CAP. 182 R.E. 2023] (i) enter in the register the prescribed particulars of the importer, exporter, producer, transporter or dealer of chemicals and any conditions prescribed under this Act; . (ii) allocate a registration number to the importer, AG O exporter, producer, transporter or dealer of of n chemicals; io iss (iii) issue to the applicant a certificate of registratpioe rnm as prescribed by the Board showing the regisutt o ration number of that importer, exporter, t wiphroducer, d transporter or dealer of chemibcu taels and any conditions subject to which it isd irs terigistered; (iv) cause to be published in the Gd aoz r ette as soon as may be practicable after registcredu ation, the prescribed particulars of each imep roorter, exporter, producer, transporter or dea lber r of chemicals, and subject to the direction y m aof the Board may cause to be so published okbo any amendment or deletion of particulartsh is i n the register; and (b) refuses to art po fprove the registration of an importer, exporter, ppao roducer, transporter or dealer of chemicals accor . N edding to the provisions of subsection (5) of section 16, etrs hv e Registrar shall thereupon inform the applicant re htsi n writing of the refusal and the reasons thereof. ll r ig Decision 2 A ia0. .–(1) The Board shall consider the application submitted in to register, n provisionally or za accordance with sections 11, 16, 17 and l8, and if it is satisfied reject applica Ttia n f on after such inquiry, or investigation, as it deems fit, may nt o e approve or reject the application for the provisional clearance, rnme or registration of the importer, exporter, producer, transporter ov G or dealer of chemicals. 02 5 (2) Upon the approval for registration or provisional ©2 clearance, the Registrar shall issue a certificate and assign a registration number. A(5) Where the Board refuses to renew the registration of ia za na chemical or permit in accordance with subsections (2) or n Ta (3), the Registrar shall inform the applicant in writing of such of nt refusal and the reasons thereof. me Cvae rn o ncellation 23.–(1) The Board may cancel the registration or provisional 5 Gof registration 2 of chemical clearance of any chemical and shall give reasons for such 20© cancellation: Provided that, in any such case the Board shall, before proceeding, give an opportunity to that person concerned to show cause why the registration should not be cancelled. 81 THE INDUSTRIAL AND CONSUMER CHEMICALS ACT [CAP. 182 R.E. 2023] (2) Without prejudice to the generality of subsection (l), the Board may cancel the registration of a chemical where: (a) the certificate was secured in violation of any of the provisions of this Act; . (b) the chemical has been banned in accordance with the G OA provisions of this Act; n o f (c) the chemical had been registered subject to conditioinsss io and those conditions have not been observed; ermp (d) the chemical has fallen into disuse; ut o (e) the chemical has been banned by any Inteithrnational d w Convention or Treaty ratified by the Unbiut teed Republic. (3) The cancellation under this section shaisltr i d l be published in the Gazette and amendments to the regisdt eo rr of chemicals shall be effected forthwith. uc e rod ep Cancellation of 24.–(1) The Board may cancel et hrb e certificate and shall give registration of y certificate holder reasons for the cancellation: ma Provided that, in any oos ku ch case the Board shall, before proceeding, give an oppios h rbtunity to the person whose certificate t applies to show ca f rtu os e why the registration should not be cancelled. pao (2) Withoudt. Nprejudice to the generality of subsection (1), the Board mayse cr vaencel the registration of a certificate holder where- (a) tst hr ee registration was secured in violation of any of the h l ri g provisions of this Act; l a. A i (b) the chemical for which the certificate holder was registered za n has been banned in accordance with provisions of this an f T Act or fallen into disuse; nt o e (c) the registration had been done subject to conditions ern m and those conditions have not been observed; ov G (d) the certificate holder has notified the Board in writing 5 02 of such withdrawal; and ©2 (e) the chemical has been banned by any International Convention or Treaty ratified by the United Republic. 82 THE INDUSTRIAL AND CONSUMER CHEMICALS ACT [CAP. 182 R.E. 2023] (3) The cancellation under this section shall be published in the Gazette and amendments to the relevant register shall be effected forthwith. Variation 25.–(1) A  certificate holder may apply for a variation of a G. of certificate A certificate so long as the certificate holder does not contravene of O the provisions of sections 11, 16, 17, 18 and 19 and anssyi o n Regulations made thereunder; and may make such applicaertmio i n where- ut p o (a) the certificate holder wants to change thith w e list of chemicals under the permit held; or ute d (b) the certificate holder wants to chang rib iset the location or premises in which the business is d oer ad lt in. (2) A person applying for variation ed uocf a certificate by giving false information in an application,p cro dmmits an offence. e r e Maintenance of 26.–(1) A person, in order toa ym b aintain his registration, shall registration and re-registration be required to comply withok mthe procedures prescribed by the Minister in the regulatio o is nbs. (2) Where cancefl th o lation of registration takes place by voluntary withdr apwa rtal of the certificate holder and application for re-registrat o d. Nion takes place before the initial registration period hase rve expired, the Registrar may re-issue a certificate of re-res gr eisstration or other certificate to the applicant after com ht rpiglying with the prescribed procedures. ll a. A Registration n2i 7.–(1) A  person shall not produce chemicals or carry on of premises a nz and facilitiesTa business or practice as a certificate holder except in premises f t o registered by the Board under this section for that purpose. n nm e (2) The Registrar shall maintain and publish periodically a er ov register of all registered premises. 5 G2 (3) The registration of any premises or facilities under ©20 this section shal1 cease to have effect upon the expiration of thirty days from the date of any change of the ownership of the business carried on-in them. (4) An application for registration or renewal of registration of premises shall be made to the Board in the prescribed form 83 THE INDUSTRIAL AND CONSUMER CHEMICALS ACT [CAP. 182 R.E. 2023] as set out in the Fifth Schedule in respect of the registration of any set of premises. (5) Information submitted under subsection (4) shall be confidential. . (6) A person who contravenes or fails to comply with this AG section, commits an offence under this Act. of O n (7) The Board may, for good and sufficient reasons refuse tsoiois register, or may cause to be deleted from the register, any premermp ises which are or have become unsuitable for the producutt o ion of chemicals, or for the lawful carrying out of chemicali th w business ute d Prohibition 28.–(1) A person shall not possess, use, distrisitbr ibute, buy or sell from dealing in chemicals listed chemicals specified under the Third, Sixth, d o Sr eventh and Eighth in Third, Sixth, Schedules unless that person is register e uec dd under this Act. Seventh and Eighth Schedules (2) A person who contravenes spurob dsection (1) commits an Act No. offence and on conviction, shallb be ere liable to- 14 of 2019 s. 33 (a) in case of a natural pmerys a on, a fine of not less than one million shillings bu k oto not exceeding five million shillings or to imprisonm b hise nt for a term of two years or to both; and of t rt (b) in case o a of p a body corporate, a fine of not less than ten m N di.l lion shillings but not exceeding two hundred mislelri voen shillings. ts re [s. 27A] ighl r Keeping of 29 l . A.–(1) The Registrar shall keep all records of chemicals, records of nia chemical za produced, imported, exported, transported, sold, dealt in, stored transactions n Ta or used in Mainland Tanzania. t o f n (2) A person who produces, imports, exports, transports or rnm e deals in chemicals in accordance with the provisions of this Act ov e shall keep a record of all quantities and qualities of chemicals 5 G 02 produced, imported, used, sold, distributed, stored, exported ©2 or transported. (3) The record kept in accordance with subsection (2), shall contain the name and address of persons involved in such 84 THE INDUSTRIAL AND CONSUMER CHEMICALS ACT [CAP. 182 R.E. 2023] transactions and any other matters that may be prescribed or contained in the conditions of registration of any chemical. (4) The record kept in accordance with subsections (2) and (3), shal1 be forwarded to the Registrar at the end of each . calendar year in a format that may be prescribed by the Board. (5) Without prejudice to subsection (4), the Board may- (a) if satisfied that it is in the public interest that a certificate to produce, import, export, transport, store or deal in 85 THE INDUSTRIAL AND CONSUMER CHEMICALS ACT [CAP. 182 R.E. 2023] a chemical should be issued or renewed, the Board shall approve issuance of a certificate or renewal of a certificate or be, to the applicant; (b) refuse to approve issuance of certificate, or renewal . of a certificate, or may revoke, a certificate under this OAG section, for any good and sufficient reason relating of n either to the applicant or certificate, or to the premisisess io in which the business is, or is proposed to be carrieped rm on. (6) The issuance of certificate under subsection (5)(uat o ) shall be as prescribed in the Tenth Schedule. ith d w (7) A separate certificate under this section sh te buall be required in respect of each set of premises in whicdh i ist r the business is carried on. d o r (8) All certificates shall be signed ce dbuy the Registrar and the Registrar shall keep a register of apllre ocertificates issued under this Act. e r b (9) A  person who produay m ces, imports, exports, stores, transports, or deals in che ok bmo icals without a certificate issued by the Board and subject t s tho i such conditions as may be prescribed, commits an offencer.t o f o p a [s. 29] d. N rve se (c) Restrictions re Restrictions, 31.–(ig1h) ts Upon application for the registration of a chemical or banning and elimination wh Aell rre after registration, a chemical is: of chemicals nia . a (a) proved to be dangerous to human life or environment; nz Ta (b) proved to be highly toxic, highly hazardous, persistent t o f or biologically accumulative; men n (c) proved to cause poisoning effect to human and animals ve r o of which no effective antidote is available; 5 G2 (d) severely restricted by National, International Convention 0 ©2 or Treaty; and (e) subject to action according to an International Convention or Treaty ratified in the United Republic, the Board shall restrict, severely restrict, ban or phase out the use and handling of chemicals specified under the Eighth Schedule. 86 THE INDUSTRIAL AND CONSUMER CHEMICALS ACT [CAP. 182 R.E. 2023] (2) Notwithstanding the provisions of subsection (1), the Board may require a restricted, severely restricted or a banned chemical to be produced, sold, distributed, transported, stored or used subject to such conditions as the Board may deem necessary. . Nical shall provide and require the employee to use such faecrvi elities and such employee may be required to use personas lr eps rotective gears conducive to the safe handling of such chht rig emical. ll . A(4) The registration under this category shall be valid for a nia nz a period of one year. Ta (5) A  person using a chemical in contravention of this ofnt section, commits an offence. me rn [s. 32] ov e G 25 Restriction 34.–(1) Notwithstanding the provisions of sections 11, 16, 17, 20 on chemicals © 18 and 19, the Board may prescribe additional requirements with which any chemical or component thereof which the certificate holder must comply with, including specifications of the composition, purity or other properties and the conditions under which the chemical shall be sold. 87 THE INDUSTRIAL AND CONSUMER CHEMICALS ACT [CAP. 182 R.E. 2023] (2) The Board may, by notice in writing, require any person who produces, deals in any chemical or on whose direction any chemical is produced or delt in to furnish it with information and particulars which that persons has in his possession. . (3) A  person who sells a restricted chemical without a OAG certificate, commits an offence under this Act. n o f [s. 3is3s] io erm Restriction on 35.–(1) Subject to any exemption conferred by the Boou t aprd or production importation under this Act, a person shall not sell by retail, offe rw i tohr expose exportation for sale by retail or supply any hazardous chemictaedls unless- and dealing in u chemicals (a) the person is lawfully conducting ais trr ibetail chemicals business; d or (b) the product is sold or supplied ciedu n premises which are registered; or pro d (c) the person is a qualified, re boer, if the transaction is carried out on his behalf bym yn a other person, and that other person is, or acts uonk o der the supervision of a qualified person. s b thi (2) A  retailer orrt ou f ser who holds more than a threshold quantity of a cheom p aical appearing under the Third Schedule to this Act shalld .n Need to apply for certificate as specified under sections 1 r s6e, v1e7, and 19 or by any other provisions of this Act. (3) Wts r ehere the Minister on advice of the Board is satisfied that h l rtighe use of any chemical is likely to cause adverse effects on. A l ia human health and the environment, the Minister may, by za nnotice in the Gazette, prohibit the production, importation, an f T exportation and dealing in such chemical. nt o e (4) Where subsection (2) applies, a person shall not sell or m ern supply any chemical unless such sale or supply is made from ov G premises capable of being closed so as to exclude the public. 02 5 (5) Subject to the provisions of this section, a person shall ©2 not sell by retail, or supply in circumstances corresponding to retail sale of a chemical of a description or a class specified by order made by the Minister and published in the Gazette except in accordance with the guidelines provided for under this Act. 88 THE INDUSTRIAL AND CONSUMER CHEMICALS ACT [CAP. 182 R.E. 2023] (6) A person whether by himself or by any other person on his behalf, produces or deals in any chemical in contravention of subsection (1) of this section or any notification issued under this section, commits an offence. [s. 34] AG. O of Prohibition 36.–(1) A person shall not be allowed to produce, import or dea n silo on productions, ism dealing in in adulterated or counterfeit chemicals. er counterfeit or (2) For the purpose of this Act, a chemical shall be t p odueemed adulterated chemicals to be counterfeit or adulterated, if it is an imitation w itohf, or is a substitute for another chemical or resembles anouteh der chemical likely to deceive, or bears upon its label or coisntrt ibainer the name of another chemical unless it is plainly d ora nd conspicuously marked so as to reveal its true character eaduc nd its lack of identity with such other chemical. d pro (3) Subject to this section, a pbee rreson shall not produce, deal in or advertise any chemicamla yp roduced in contravention of subsection (1). ok o (4) A  person who cso bhi ntravenes any of the provisions of t subsection (1), comrtm o f its an offence. a o p [s. 35] N ed . se rv (d) Inspection re Appointment 37. A l ia ar the actual costs of the analysis. n za (5) The Board may request that any chemical be analysed n f T a for the purpose of implementing the provisions of this Act. nt o e [s. 40] m Dvee rn o signated, 42.–(1) In addition to the designated laboratories, the Minister 5 Greference 02 laboratories and may, by order published in the Gazette, appoint additional ©2 certificate of designated laboratories and reference laboratories as he may analysis deem fit for the implementation of the provisions of this Act. (2) The designated laboratory or the reference laboratory shall issue a certificate of analysis stating the results of analysis of any substances submitted in accordance with this Act. 91 THE INDUSTRIAL AND CONSUMER CHEMICALS ACT [CAP. 182 R.E. 2023] (3) The certificate of the designated laboratory, or the reference laboratory shall state the method of analysis followed and a certificate shall be signed under the hand of the person in charge of that designated or the reference laboratory or any . person designated by him in writing. (f) provide to the Board, all information on the chemical OAG and its handling that may be needed to assess the hazards of n it presents to human health or to the environment. io iss (2) A  person who distributes, sells, transports, imppeo rmrts, exports, stores or deals in a chemical, shall through a regoisu tt ration method which accords medical surveillance of itohrkers as d w necessary- te bu (a) assess the health of workers in redlia i sttrion to hazards caused by exposure to chemicals; or d (b) diagnose work-related diseaseds e u cand injuries caused by exposure to hazardous chemepi rocals; (c) where the results of med bice ar l test or investigation reveal clinical or preclinical m e affy ects, take measures to prevent or reduce exposuoro k b e of the workers concerned, and prevent furthe rth d is eterioration of their health; (d) use the resu lotfrt s of medical examination to determine health stoa tpu a s with respect to exposure on chemicals, and sehda . Nll not use the result to discriminate against the wosrekr ver; e (e) htsrer cord results from the medical surveillance of workers ig ll r and shall keep them for a period of five years; A ia. (f) have workers access to their medical records, either n nz a personally or through their own physicians; Ta of (g) have the confidentiality of individual records respected nt e in accordance with the generally accepted principles of rnme medical ethics; v G o (h) issue the results of medical examinations and clearly 5 20 2 explained to the workers concerned through their © physician or medical practitioner; (i) ensure that, worker and their representative have access to the results of studies prepared from medical records where individual workers cannot be identified; and 93 THE INDUSTRIAL AND CONSUMER CHEMICALS ACT [CAP. 182 R.E. 2023] (j) avail the results of medical records to enable preparation of appropriate health statistics and epidemiological studies, provided anonymity is maintained, where this may aid in the recognition and control of occupational . diseases. (6) A person who imports unlabproe elled, obsolete or expired chemical commits an offence ea r b nd on conviction shall be liable to a fine of not less mth ayan five million shillings or to imprisonment for a term ok b o f six months or to both. s f th i [s. 42] rt o Chemical and 44.–(1) A  persoon p ashall not be allowed to import chemical Chemical wastes Act No. wastes in the  N dc.o untry. 14 of 2019 s. 36 (2) The Brvoese ard shall, on the basis of scientific research, assess levels o e tsf rchemical wastes in the social and economic activities and gh l riprescribe safety measures for exportation, production, l sat.o A i rage, dealing in and disposal of such wastes. anz (3) A person handling chemical wastes shall have sufficient an f T knowledge to handle such wastes. t o en (4) A person handling a chemical shall- rnme (a) take such steps and precautions to ensure that Gov accumulation of chemical wastes is avoided; 5 02 (b) be responsible for- ©2 (i) keeping records on chemical and their wastes; (ii) inform the Registrar on regular basis on the accumulation of chemical wastes; and (iii) safe and environmentally sound disposition of any chemical wastes generated. 94 THE INDUSTRIAL AND CONSUMER CHEMICALS ACT [CAP. 182 R.E. 2023] (5) The Registrar shall ensure that a waste incinerator is in place and if there is none in place he must ensure that, his institution is collaborating with other relevant institutions to develop risk reduction measures in order to reduce ecological . and human health risks. OAG (6) Unless otherwise directed by the Board, specially trained f n o personnel shall handle waste chemicals for temporary storaigse io s or for final disposal. ermp (7) The Board may set up economic instruments too mu t anage chemicals and chemical wastes for the purpose of pit w rheventing d and mitigating environmental degradation. te bu (8) A  person shall not dispose of any ch ri dise tmical, chemical wastes, chemical containers without obd toa r ining a certificate from the Board issued after consultdaut cieon with the National Environment Management Counceipl r oor any other competent authority or institution as the B obea rrd may deem fit. (9) A  person who impo ay rmts or handles highly hazardous chemicals set out in the Sixotob hk Schedule, shall seek authorisation from the Board. his t (10) The final drit sop f osal of any hazardous chemical wastes may only be exeoc up ated by personnel having a certificate issued by the Board. . Ned (11) A speer vrson shall not be allowed to unload and repackage e impor r httesd or transit bulk chemicals in the port unless such ope ig llr ration is undertaken at the designated port or area. A ia. (12) A  person who contravenes the provisions of this za n n section, commits an offence under this Act. Ta of [s. 43] nt e Diesrpno msal of 45.–(1) A person involved in the disposal of chemical wastes shall ocvhemical wastes G apply to the Board for a certificate, and an application shall be 5 02 in writing and contain information on- ©2 (a) the nature and quantity of the chemical wastes the applicant intends to treat and dispose of; (b) the source and nature of the waste; (c) where and in what manner the chemical wastes is to be treated and disposed of; 95 THE INDUSTRIAL AND CONSUMER CHEMICALS ACT [CAP. 182 R.E. 2023] (d) scientific knowledge that the methodology will not result in adverse effects to health and environment; and (e) any other conditions of importance for evaluating the nature and scope of the activity. . (2) Notwithstanding subsection (1), any firm may in its own AG O plant, finally dispose of chemical wastes that are not generated n o f from the plant, if a certificate for the plant has been issuiessd io pursuant to this Act, and if the company utilizes only a semrmp all portion of the plant for the treatment. ut o (3) The treatment referred to in subsection (2),i th d w shall not commence unless the firm has submitted a not te biufication to the Registrar fourteen days in advance. tri dis (4) The Board shall send a copy of a r dn ootification received under subsection (3) to the National Enduv cieronment Management Council, local authority and other ro e pauthorities or institutions engaged in environmental healthe  pr b rotection. (5) A  person who contr avaym enes this section, commits an offence. ok bo is of th [s. 44] rt Prevention and 46.–(1) The cert a oifi pcate holder shall- management of (a) take sud.c N accidents h steps and otherwise observe such precautions as rve saere needed to prevent accidents and therefore harm tst or e human health and environment and such steps h l ri g shall include: A l ia. (i) monitoring of safety, through adequate maintenance n za of operations and inspections; an f T (ii) choice of adequate route avoiding obstacles, peak t o en hours and densely populated areas and hence have ern m a suitable carriage; v G o (iii) avoiding over loading of chemicals; 02 5 (iv) taking precautions consummerte to properties of ©2 the chemical; (b) prepare contingency plans and procedures for managing accidents which shall be presented to the Board for approval; 96 THE INDUSTRIAL AND CONSUMER CHEMICALS ACT [CAP. 182 R.E. 2023] (c) in the case of an accident, immediately put into effect the approved contingency plan; (d) in the case of a spill, immediately respond, including notifying the circumstances of the spill and any action . taken or proposed to be taken in relation to the spill OAG to the public, the Registrar, the Board and any other of relevant authorities; and sio n is (e) document and report every accident or spill toe rmp the Board and other relevant authorities and theo up t ublic, with details as may be prescribed by the Boaritdh . d w (2) A  certificate holder who holds hig te bhuly hazardous chemicals shall perform a risk assessment and srtrdi iisk management program and submit a summary of the Pdr o rg ram to the Board, in a type and format that as may be prde cseu cribed by the Board. (3) Where a certificate holder fa ro epils to notify the public, the Registrar, the Board and any oth ebre ar uthorities or fails to put into effect the approved contingenmca y y plans beyond eight hours after the accident, this shall be odob ekemed to be a continuing offence. (4) A certificate holdhies t r who causes an accident or spill shall forthwith do every tohfrt ing practicable to prevent, eliminate, restore and amoe lpi aorate the adverse effects of the accident or spill. . N ed (5) A perrvs son or local authority who is informed of a spill e and ofh tas nr y contaminated site shall notify the Registrar. (ll6 ri) g A certificate holder who contravenes the provisions of tiah. i As section, commits an offence. an nz [s. 45] Ta of Manage t emn ent 47.–(1) The certificate holder shall- of spimlls and coenrtnaminated (a) take all necessary steps to prevent spillages and Gov sites contamination of the environment; 250 (b) prepare contingency plans and procedures for ©2 managing spills and contaminated sites, which shall be presented to the Board for approval; (c) in the case of an accident, immediately respond, including notifying the circumstances of the accident and any action taken or proposed to be taken in 97 THE INDUSTRIAL AND CONSUMER CHEMICALS ACT [CAP. 182 R.E. 2023] relation to the accident to the public, the Registrar and any other relevant authorities; (d) in the case of a spill, immediately notify the public, the Board and other relevant authorities for further action, and put into effect the approved contingency plan; and AG. (4) The Board shall p ok broescribe the procedures for clean-up and removal operationsis i th n the event of a spill. (5) The Board srht oa f ll prescribe the method of storage and disposal of any p poao llutant of any object, plant, animal, or any part of the eend .v Nironment removed in a clean-up or removal operations oerr v otherwise affected by a pollutant. e (6) hAts  rperson affected in a way by a spill shall have a right to dam ig ll rages or compensation from the chemical dealer. ia. A(7) The certificate holder shall be liable for the expenses n nz a incurred during clean up operations and any damages caused a of T by a spill, accident or contaminated site. nt e (8) The pollutant shall be in the custody or employment of rnme the certificate holder who causes spill. Gov (9) The Board may recover from the certificate holder who 5 20 2 causes a spill, accident or a site to be contaminated all costs © and expenses incurred as a result of- (a) any clean-up or removal operation; (b) any measure taken to prevent, eliminate and ameliorate the adverse effects of a spill on the environment; and 98 THE INDUSTRIAL AND CONSUMER CHEMICALS ACT [CAP. 182 R.E. 2023] (c) any measure taken to dispose of, to deal with the spill and contaminated site; (d) monitoring of the environment, public health or any other factor as it may deem fit. . (10) Where a certificate holder fails to notify the public, AG O the Board and other authorities or fails to put into effect the n o f approved contingency plans beyond eight hours after the spislilois or accident, this offence shall be deemed to be a contipneu rming offence. ut o (11) A person who knowingly fails to inform th wei thRegistrar d or any other relevant authority of any certificabute te holder who contravenes the provisions of this section, co tri r d mis mits an offence. d o [s. 46] e uc Decommissioning 48.–(1) When a certificate holder rodd ecommissions a plant, of plants p shall take such steps and other e bew rise observe precautions as are needed to ensure that, mhaay rm to human health and the environment is prevented oako n d the steps and precautions shall include- his b t (a) an Environrm t o fental Impact Assessment and ensure that all reo mp aaining stocks of chemicals are disposed of soundly. Nd as well as the equipment; and (b) thaet rvs tehe holder make good the plant site. (2) As  r e t person who contravenes the provisions of subsection (1), gh l criommits an offence. Al ia. [s. 47] za n n f T a PART V t o en FINANCIAL PROVISIONS ern m Gov Funds and 49.–(1) Without prejudice to the generality of Part V, the 5 02 resources of 2 Government Government Chemist Laboratory Authority shall establish an © Chemist account into which all moneys received shall be paid and out Laboratory Authority of which all payments required for chemical management and Act No. control shall be made. 14 of 2019 ss. 27 and 37 (2) The account shall be administered by the Registrar. 99 THE INDUSTRIAL AND CONSUMER CHEMICALS ACT [CAP. 182 R.E. 2023] (3) The moneys shall be applied for the furtherance of the objectives of this Act, including public awareness on the safe handling of chemicals, and any other activities of the Authority. (4) The funds of the Government Chemist Laboratory . (4) A  veterinary or livestock officer who has reason to za an believe that, certain ailments and deaths of animals occurring T t o f in the area under his charge may be linked to exposure to any n rnm e chemicals, shall notify the Registrar forthwith. ov e [s. 51] 5 G 022 Inquiry or 53.–(1) The Registrar may upon receiving a notification under © investigation section 52, cause an inquest to be carried out in accordance Cap. 24 with the provisions of the Inquest Act. 101 THE INDUSTRIAL AND CONSUMER CHEMICALS ACT [CAP. 182 R.E. 2023] (2) The person or persons holding an inquest under this section, shall within six months report to the Registrar their findings and recommendations. (3) The Registrar shall report to the Board on the findings . and recommendations of the inquest and the measures to AG be taken. of O n (4) A  person obstructing a duly authorised officer io istso conduct an inquest under this section, commits an offenpcerm. ut e tho [s. 52] wi Liability of 54.–(1) Where an offence against this Act is ctoedmmitted by body corporate, u partnerships, a body corporate, a director or officer of thiest r ibbody corporate agents, principles who had knowledge or should have ha d dor knowledge of the and employers commission of the offence, commits an ed uc offence. (2) Where an offence is commiptrtoe dd against this Act by a partnership, a partner or officer orebe f the partnership who had knowledge or should have hmaday knowledge of the commission of the offence, commits ano oo k ffence. (3) A person shall beh ips bersonally liable for any offence against t this Act, whether co rt mo f mitted by him on his own account or as an agent or serva npao t of the person. . Nd [s. 53] rve se Liability of 55. A  m rees mber of the Committee, the Registrar or any other committee t members and pers orign h empowered to perform any function under this Act, employees sh. Aa llll not be liable for any Act done in good faith in execution ia za nor purported execution of his function under this Act. an [s. 54] of T nt Forfnemitu ere, 56.–(1) The Court before which a person is prosecuted for an cvaen rcellation and other orders offence against this Act or the regulations made thereunder 25 G shall order that the substance, equipment and appliances 20© used in the commission of the offence be forfeited to the Government or be disposed of as the court may direct. (2) In making an order for disposal under subsection (1), the court shall order that the costs of disposing of the substances, 102 THE INDUSTRIAL AND CONSUMER CHEMICALS ACT [CAP. 182 R.E. 2023] equipment and appliance as provided for in subsection (1) be borne by the accused.
