Abstract
The respondent, International Commercial Bank (T) Ltd filed a suit in the High Court of Tanzania (Commercial Division) against inter alia, the two appellants herein, Rungwe Freight & Construction Co.Ltd and Jimmy Brown Mwalugelo (the1st and 2nd appellants respectively). The appellants were jointly sued with two other persons, Ladislaus Mpokwa and Burton Joram Lemanya who, together with the 2nd appellant, were the directors of the 1st appellant.
